INS Teaching Booklet Lies to Immigrants about Second Amendment

Not Charles Schumer, not Sarah Brady ... but the U.S. Immigration and Naturalization Service (INS) is actively teaching immigrants that "gun control" is part of our Constitution. The INS is lying, pure and simple. The INS's false statements cannot be counted as "mistakes" -- the Constitution is short enough that anyone can read it; the Bill of Rights is even shorter.

On page 2 of that document, it states:

"The Founding Fathers believed that the right to life, liberty and the pursuit of happiness was very important. This right is the basis for all of the rights listed in the Constitution and its amendments.
These include:

  • right to freedom of religion;
  • right to freedom of speech;
  • right to bear arms, or to own weapons (a special permit is required);
  • right to a trial when accused of a crime, and to know of what crime one is accused; and,
  • right to own property and to expect the government to help protect private property.

These are rights guaranteed by the Constitution to both citizens and non-citizens who live in the United States."

Never mind the grammatical error in the use of "right" in the first sentence -- there is absolutely no "special permit" requirement anywhere in the Constitution and Bill of Rights.

Now, skip down to page 5:

"Amendment 2

Guarantees the right to have weapons or own a gun, though subject to certain regulations. (Also called the right to bear arms.)"

There is no provision for "certain regulations" in the Second Amendment. The language of that Amendment says the people's right to keep and bear arms "shall not be infringed."

These statements about the Second Amendment are false, and because they are knowing false statements, they are lies. The INS is propagandizing prospective new citizens to embrace "gun control" as a fundamental principle of our system.

Action Point: Here is the substance of a letter that you could use to ask your elected representatives and other influential people to pressure INS to correct the false statements.

The Immigration and Naturalization Service (INS) has published a document for teaching civics to prospective citizens, and that document contains at least two obvious false and misleading statements. The document, entitled the United States Government Structure Study Guide for Civics Exam, is located at:

On page 2, that document states that the Constitution protects the "right to bear arms, or to own weapons (a special permit is required)."

On page 5, the document explains the Second Amendment:

"Amendment 2

Guarantees the right to have weapons or own a gun, though subject to certain regulations. (Also called the right to bear arms.)"

Both of these statements are false. There is no "permit" requirement in the Constitution or Bill of Rights. The Second Amendment does not qualify the right to keep and bear arms with the phrase "subject to certain regulations." As you know, the Second Amendment declares that the people's right to keep and bear arms "shall not be infringed." On its face that language precludes any "permit" or "regulation" that would "infringe" the right.

The INS document teaches prospective citizens a doctrine of "gun control" that is not part of the Constitution. I am not asking the INS to take a position on "gun control," I am asking that the INS take no position: just state what the Second Amendment says. Quote the language. If the Second Amendment needs an explanation, then explain it accurately: that it protects the right of the people to keep and bear arms.

A government agency that knowingly and falsely states fundamental laws of our Republic cannot be tolerated. Please take whatever steps are necessary to require the INS, in all of its publications, to tell the truth and take no political position on the Second Amendment.
